Introduction

These Terms & Conditions (“Terms”) govern the use of the sentiment analysis services (“Services”) provided through SBSAiSenti.com, owned and operated by KVN Software Pvt Ltd, a company incorporated under the laws of India, having its registered office at 2nd Floor, Sarika CHSL,Bhakti Mandir Road, Thane West 400602 (“Company,” “we,” “our”). By using SBSAiSenti.com, you (“Customer,” “you”) agree to these Terms.

1. Services Offered

SBSAiSenti.com provides AI-powered sentiment analysis services that process customer-uploaded text comments (limited to 150 characters each).

2. Content Restrictions

You agree not to upload comments that contain or promote:

Hate speech or harassment
Violence or threats of violence
Sexually explicit, vulgar, or obscene material
Discriminatory, defamatory, or illegal content

Comments containing such material may be automatically filtered and omitted from processing, without notice or refund.

3. Automated Filtering & Processing Limitations

SBSAiSenti.com uses third-party AI providers (including OpenAI and Microsoft Azure), each applying independent content moderation filters.
As a result, the number of processed comments may be fewer than the number submitted.
SBSAiSenti.com does not control which comments are omitted and cannot provide a list of excluded items
Some comments acceptable to customers may still be rejected by AI filters.
Such omissions are not service errors and do not entitle customers to refunds, credits, or reprocessing.

4. Data Retention & Ownership

Raw comments uploaded will be retained for 30 days only and automatically deleted thereafter.
Processed analysis results may be stored longer for reporting and customer access.
Customers retain ownership of their data. SBSAiSenti.com will not use customer data for AI training without explicit consent.

5. Payment, Refunds & Discounts

Services are billed as per the applicable pricing plan.
No free services and no refunds will be provided under any circumstances.
Promotional discounts may be offered for limited periods but do not alter these Terms.

5A. Fair Usage & Upgrade Credits

In case of plan upgrades during an active subscription, SBS AI Senti may credit the value of unused uploads or AI recommendation add-ons from the current plan toward the new plan. Such credits are calculated proportionally and applied as discounts on the payable amount. No cash refunds or transfers are offered.

6. Limitation of Liability

SBSAiSenti.com and KVN Software Pvt Ltd are not liable for:

Losses, damages, or liabilities arising from omissions by third-party AI providers.
Business decisions or consequences based on AI-generated outputs.
Indirect, incidental, or consequential damages.

7. Governing Law, Jurisdiction & Arbitration

These Terms are governed by the laws of India.
Any disputes will be resolved under the Arbitration and Conciliation Act, 1996, as amended.
Arbitration shall be conducted in Mumbai, India, with one arbitrator jointly appointed by the parties.
Customers waive rights to class actions; disputes must be individual.

8. Entire Agreement

These Terms constitute the entire agreement between you and KVN Software Pvt Ltd regarding the use of SBSAiSenti.com
